Abstract
I takt med att EU-integrationen fortskrider påverkas kollektivavtalen i medlemsländerna alltmer och arbetsmarknadsparternas förhandlingsutrymme begränsas. Detta trots att EU har starkt begränsad lagstiftningskompetens när det gäller den kollektiva arbetsrätten och ska främja dialogen mellan arbetsmarknadens parter och respektera deras självständighet. Samtidigt har integrationen skapat utrymme för förhandlingar och kollektivavtal på EU-nivå. I artikeln undersöks de mekanismer som har lett till denna utveckling och en helhetsbild av kollektivavtalets ställning i EU-rätten tecknas.

In step with the continuing EU integration, collective agreements in the member
states are increasingly affected, and the social partners’ room for negotiations
is narrowed. This is so despite the fact that the EU has limited competence to
legislate on collective labour law, and that it shall facilitate dialogue between the
social partners and respect their autonomy. At the same time, this integration has
created scope for negotiations and collective agreements at EU level. This article
analyses the mechanisms that have led to this evolution and draws an overall
picture of the status of the collective agreement in EU law.
